Darbsonfunding.com (and its affiliate companies and/or its associated websites – all herein collectively referred to as “Darbson” or as “We”) strives to offer its visitors the many advantages of Internet technology and to provide an interactive and personalized experience.  We may use Personally Identifiable Information (your name, e-mail address, street address, telephone number) subject to the terms of this privacy policy.  We will never sell, barter, or rent your email address to any unauthorized third party. 

So that clients and/or prospects may receive proper consideration for our services, we collect various types of information about you on behalf of third party sources and/or providers. Examples of such information are:

  • Information you provide in order to obtain or maintain a service or product, such as loan application data

  • Communications from you regarding your loan(s), such as a change of address request

  • Information gathered from your transactions and account history with us, our affiliates, and others, such as your loan payment history

  • Information obtained from third parties such as consumer reporting agencies or credit bureaus, employers, depository institutions and others, that we use to evaluate a loan application 

Sharing of personal information with other companies

We may share information about you, as a current or former customer, within our company in order to provide you with better service and information about financial products that may interest you. However, we do not share personal financial information obtained from applications or credit reports with another company unless it is helping us respond to your request or service your existing relationship with us, such as helping us evaluate your application.

Sharing of personal information with third parties

Individuals or companies outside of our company are considered third parties. Mortgage lenders and private funders are permitted (and sometimes even required) to share customer information with third parties for certain purposes, such as servicing customer relationships, fraud and risk management, and responding to transaction requests.

We may share personal information with a third party company in order to offer or support a product or service that we provide to you.

We also share personal information as legally required. We may share personal information with law enforcement agencies or other third parties to prevent or investigate suspected fraudulent activities.

We may also provide personal information regarding our customers’ accounts to credit bureaus for credit reporting purposes. If you believe we have provided inaccurate information to a credit bureau, please contact us in writing with your account number and other pertinent information.

Sharing of personal information with marketing companies

We do NOT sell customer or former customer lists or personal information to list brokers, marketing firms or to other third parties.

How we keep information private

We have internal policies and procedures designed to keep customer information safe. These include:

  • Allowing access to customer information only to authorized employees performing specific job responsibilities necessitating such access

  • Maintaining physical, electronic and procedural safeguards that comply with federal regulations to protect customer information

  • Training employees on privacy and disciplining any employees who violate our procedures

Reporting incorrect information

If you believe any information we have about you or your relationship with us is incorrect, please notify us at once. We will take prompt action in making the appropriate corrections. You may contact us in person, by phone or mail.

Governing law 

This policy and the use of this website are governed by Texas, U.S.A. law.  If a dispute arises under this Policy we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Dallas, Texas USA.  Any costs and fees other than attorney fees associated with the mediation will be shared equally by each of us. 

If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at the following location: Dallas, Texas USA, under the rules of the American Arbitration Association.  Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.

Darbsonfunding.com is controlled, operated and administered entirely within Texas.  This statement and the policies outlined herein are not intended to and do not create any contractual or other legal rights in or on behalf of any party.
